North Carolina wrongful death: Woman hit while refueling her car

A devastating accident has occurred on the highway killing a 25-year-old woman and injuring another. Another motorist, a 55-year-old male driver involved in the accident, is now facing a charge of misdemeanor death by motor vehicle. North Carolina authorities do not believe that the other driver was under the influence of any substance, however, he may still be subject to a wrongful death claim brought on by family members.

The accident reportedly occurred on the interstate when the woman was situated on the side of the road after apparently running out of gas. The woman and a friend were in the process of refueling the vehicle when tragedy struck. The male driver was traveling on the ramp, but did not see the car parked on the shoulder. The man apparently slammed into the back of the vehicle, killing the woman. The woman leaves behind her 6-year-old daughter.

The woman’s friend was injured in this crash, although the extent of their injuries is unknown. Before the fatal night, the woman suffered from a condition called epilepsy, which resulted in her resigning from her place of employment. The other driver has been described as a person with a good heart and a caring disposition.

This tragedy has left a young girl without her mother and other family members without their loved one. There are likely memories that the family cherishes as they grieve their sudden loss. The surviving family retains the right to seek recovery of damages suffered as a result of this North Carolina accident. A wrongful death claim may be filed on behalf of the deceased and financial relief may be obtained if the other motorist is deemed the responsible party.
