North Carolina: possible wrongful death claim?

North Carolina police were recently called to the scene of a deadly car accident that has left a three year old child without a mother. Family members of the deceased mother may have a right to file a wrongful death claim against the state. There may be a question over whether a stop sign was clearly visible at the intersection where the accident occurred.

Police who are working to find out what may have caused the wreck have stated that there was no evidence that either driver had tried to take evasive action before the collision. The 28-year-old mother who was driving is thought to have run a stop sign and entered the intersection where she was smashed into by another car. The driver of that vehicle was also injured in the wreck.

The car that was driven by the mother wound up smashing into a shed that was just off the road. The roof of that structure then fell on top of the car. The mother and a 13-year-old relative were both killed in the wreck. The young child was secured into the back seat of the car and was taken to a hospital for treatment of undisclosed injuries.

Residents who lived close to the intersection have stated that it is irregular in shape and that there is a good deal of greenery overgrown in the area. One man reportedly contacted roadway officials about the location of a stop warning sign, which was allegedly moved within hours of the complaint following the deadly crash. If the state failed to maintain the intersection with proper trimming and clear sign placement, then it may be possible for the families of the victims to file a wrongful death claim against North Carolina. There are resources available that may be able to provide information regarding the filing of such actions that could possibly help the survivors cope with the enormous costs that these tragedies can cause.
